The Kerala High Court has allowed a government committee to resume negotiations with Mediterranean Shipping Company over environmental damage and compensation arising from the sinking of MSC Elsa 3. The court also directed stakeholders to submit inputs within one week for a proposed underwater survey of the wreck site.
MSC Elsa 3 compensation talks can resume following a Kerala High Court order recalling an earlier restriction on negotiations by a special committee of government officers.
A Division Bench comprising Justice Raja Vijayaraghavan V and Justice K. V. Jayakumar issued the directions on 27 October 2026 while considering public interest petitions concerning marine pollution, navigational hazards and the impact of the sinking on coastal livelihoods.
The committee’s remit includes assessing environmental damage, identifying restoration and remediation requirements, and addressing economic losses suffered by the State and fishing communities. Its work provides an institutional channel for engagement with Mediterranean Shipping Company (MSC).
